1. Scope

These Terms and Conditions apply to all orders placed through www.dirtyrootsberlin.com, operated by:

2. How Orders Work

  • The products on our website are an invitation to make an offer (invitatio ad offerendum), not a binding offer.
  • When you place an order, you are making a binding offer to purchase.
  • The contract is formed when we send you an order confirmation email.
  • We reserve the right to decline orders (e.g., if a product has already been sold -- our planters are one-of-a-kind).

3. Prices and Payment

  • All prices are final. As a Kleinunternehmer under Section 19 UStG, no VAT (Umsatzsteuer) is charged.
  • Payment is due at the time of ordering.
  • We accept: credit card (Visa, Mastercard), PayPal, Apple Pay, Google Pay.

4. Shipping and Delivery

  • Planters with live plants: EU delivery only. Estimated delivery: 5-10 business days.
  • Empty planters, book, wooden stands, gift cards: Worldwide shipping available. Estimated delivery: 5-15 business days depending on destination.
  • Delivery times are estimates, not guarantees. Delays may occur due to customs or carriers.
  • Risk of loss passes to you upon delivery. If a package arrives damaged, contact us immediately at hello@dirtyrootsberlin.com with photos.

5. Right of Withdrawal

Summary: You have 14 days to return most items without giving a reason. One-of-a-kind handmade planters may be excluded under Section 312g(2) No. 1 BGB. Damaged items are always replaced or refunded.

6. Warranty (Gewahrleistung)

The statutory warranty period of 2 years from delivery applies to all products, as required by EU law.

Our planters are handmade from concrete and natural materials. Minor variations in color, texture, and form are inherent to the handmade process and are not defects. These are features of a one-of-a-kind art piece.

7. Liability

We are liable without limitation for damages caused intentionally or through gross negligence. For slight negligence, we are only liable for breach of essential contractual obligations (Kardinalpflichten), limited to foreseeable, typical damages.

This does not affect liability for injury to life, body, or health, or liability under the Product Liability Act (Produkthaftungsgesetz).

8. Intellectual Property

All content on this website (text, images, designs, the book "Leave it the Fuck Alone") is owned by Adam Cotorceanu / Dirty Roots Berlin. Don't copy it.

10. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Governing Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer resident in the EU, you also benefit from any mandatory provisions of the law of your country of residence.

12. Changes

We may update these terms from time to time. The version in effect at the time of your order applies to that order.
